Expedited Processing of H-1B Cap Filings will Hit the Pause Button

The USCIS has announced that premium processing service (“PPS”) for H-1B petitions received during the first 5 business days of April may be postponed until as late as May 16, 2016, in order to provide adequate time for the government to perform initial intake, data entry, and the issuance of receipts for the high volume of petitions expected. As a result, employers requesting PPS may not receive any word (approval, denial, or RFE) until as late as May 31.
Though PPS results in earlier notifications to the employer, it does not provide any advantage whatsoever with regard to the likelihood of a petition being selected in the H-1B lottery.
